Welcome to CinematicTale. By accessing or using the website at https://www.cinematictale.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and CinematicTale under the Indian Contract Act, 1872, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and other applicable Indian laws. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

CinematicTale is an AI-powered storytelling platform that enables users to create illustrated stories and comic books. The Service uses artificial intelligence (Google Gemini and Kie.AI) to generate story text and comic-style images based on user-provided prompts.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice where possible.

• You must be at least 13 years old to create an account. Users between 13 and 18 must use the Service with verifiable parental or guardian consent, in line with the DPDP Act, 2023.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and current information when registering.
• You must notify us immediately at saurabhjadhav.devstudio@gmail.com if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the Service to:

• Generate content that is illegal, hateful, defamatory, obscene, or violates any third-party rights.
• Create content that sexualises or exploits minors in any way.
• Harass, threaten, or abuse other users or third parties.
• Attempt to reverse-engineer, hack, or exploit the Service or its infrastructure.
• Use automated scripts, bots, or crawlers to access the Service without our permission.
• Circumvent rate limits, credit systems, or other usage controls.
• Impersonate another person or entity.
• Use the Service in any manner that violates applicable Indian or international law.

We reserve the right to remove any content and terminate accounts that violate these guidelines, without refund.

The Service uses AI models (currently Google Gemini and Kie.AI) to generate story text, images, and video clips based on your prompts and any reference photos you choose to upload. Please be aware of the following:

• Ownership of output: You retain ownership of your original prompts. To the extent permitted by law, you also own the AI-generated text, images, and video clips you generate using your prompts, subject to these Terms and our AI providers' terms (including Google's Gemini API terms and Kie.AI's terms). You grant CinematicTale a worldwide, royalty-free licence to host, store, display, and process this output strictly to operate the Service.
• Commercial use: Generated content may be used for personal or commercial purposes by paid plan users (Starter and above) within the limits set by our AI providers. Sale of standalone AI-generated artwork as "unique" or NFT is at your own risk and is not warranted by us.
• Reference photos / Feature Yourself: If you upload a photo of yourself, you represent that (a) you are the person in the photo, or have explicit consent from the person shown, and (b) the photo does not depict a minor. You must not upload photos of public figures, other identifiable individuals without consent, or copyrighted celebrity images.
• Accuracy: AI-generated content may be inaccurate, offensive, biased, or inappropriate. You are solely responsible for reviewing all generated content before publishing or sharing it. We are not liable for AI output content.
• No guarantee of uniqueness: AI models may produce similar content for different users. We do not guarantee exclusivity of any generated output.
• Public stories: Stories you mark as "public" may be displayed on the Explore page and visible to all users. By making a story public, you grant CinematicTale a non-exclusive licence to display it on the platform until you change its visibility or delete it.
• Training: We do not use your prompts, reference photos, or generated content to train any model. Our AI providers may have their own data-handling policies — see Privacy Policy section 5.

All software, design, trademarks, and branding of CinematicTale (excluding user-generated content) are the intellectual property of CinematicTale and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our platform without explicit written permission.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the content generated by AI models.

To the maximum extent permitted by applicable law, CinematicTale shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you exceed the amount you have paid to us in the 12 months preceding the claim, or ₹1,000 (whichever is greater).

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by emailing saurabhjadhav.devstudio@gmail.com.

If a dispute remains unresolved 30 days after written notice, the parties agree to submit the dispute to the exclusive jurisdiction of the competent courts in India. Nothing in this clause prevents either party from seeking urgent injunctive relief from any competent court.

We may update these Terms from time to time. We will notify you of material changes by updating the effective date and, where appropriate, by emailing you. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
